IPR Protection in China

Plougman & Vingtoft hosted the Member Meeting on 11 May 2009, with the theme “IPR Protection in China”

Ms. Hao Qingfen, Chairwoman and Founder of Dragon IP Law Firm, gave a speech about patent protection in China. See talked about the latest development in application and granting of patents in China. She also touched upon the importance of obtaining patent protection in China as early as possible and how a patent litigation typically will proceed.

Ms. Zhong Jing, Deputy General Manager in Dragon IP Law Firm, had her focus on trademark protection in her presentation. She talked about the trademark registration procedure in China and the different ways to enforce trademark right. She gave some examples on trademark infringements and why preventive trademark registration is important. Finally, she gave the following advices for Danish companies doing business in China:

• Apply for the trademark not only in English/France/Japanese spelling, but also the trademark in favourable Chinese characters.
• Register your trademarks in all the relevant product classes.
• Make ongoing trademark searches on the Chinese Trademark Gazette.
• Investigation and collect evidence as soon as possible in case of infringements.
• Cooperate with a local law firm and work out proper plans.
